Price, Delivery, and Returns

Where applicable, the price of any Product purchased through the Site will be the price specified in the Site at the time of your purchase. PT JPPL Indonesia will not issue refunds based upon inaccuracies represented by the purchaser. By approving the purchase of the product, you authorize PT JPPL Indonesia to charge for the purchase.

Service Subscription: This service requires you to open an account. You must complete the registration process by providing PT JPPL Indonesia with current, complete and accurate information as prompted. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify PT JPPL Indonesia immediately of any unauthorized use of your account or any other breach of security. PT JPPL Indonesia will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by PT JPPL Indonesia or another party due to someone else using your account or password. The Service subscription is not transferable, such that you may not authorize other persons to use your account. Any distribution by you of your account name and password may result in cancellation of your subscription without refund and in additional charges based upon unauthorized use. Delivery: Delivery of Product(s) purchased pursuant to these Terms will be made directly to your mobile phone. The details of the delivery process will be provided to you at the time of purchase. Delivery is conditional. In order for proper delivery, your mobile phone must be turned on; capable of receiving the Service; set to receive text messages. Ordered Service can only be delivered when the cellular phone is on a compatible network, a full list of which is available on the order form. Provided that the mobile phone and the mobile operator’s network will accept the Service delivery of the Service will occur within 24 hours of completion of the order. Typically, delivery of the Service occurs within a matter of seconds. We will attempt to deliver the ordered Service a total of three times to the same cellular phone. If the Service has not been successfully delivered, please notify us within 7 days. If you do not notify us within this period, we will presume that the Service has been received. If the Service cannot be delivered, PT JPPL Indonesia will refund the payment, provided that the Service’s non-delivery to the mobile phone is not the result of the purchaser’s error. If the purchaser’s error caused the non-delivery, payment will not be refunded.

Order Process

Termination of Service Contract

PT JPPL Indonesia shall be entitled to (i) cancel the Contract or suspend any further deliveries of the Goods and/or the Services under the Contract without any liability to the Purchaser, and (ii) if the Goods and/or Services have been delivered or completed but not paid for, the price shall become immediately due and payable notwithstanding any previous agreement or arrangement to the contrary, and (iii) retain any security given or monies paid by the Purchaser and apply the said security or monies against the assessed loss and damages, if any, suffered by PT JPPL Indonesia, in the event that:

(a) The Purchaser is in material breach of any terms of the Contract; or

(b) The Purchaser makes any voluntary arrangement with its creditors or (being an individual or firm) becomes bankrupt or (being a company) goes into liquidation (otherwise than for the purposes of amalgamation reconstruction) or have an order made or resolution passed for such winding- up or shall otherwise become insolvent or make such assignment or arrangement for the benefit of its creditors or have a receiver or manager appointed over its affairs or have an application made to court for the appointment of a judicial manager or be placed under a judicial management order; or

(d) The Purchaser ceases, or threatens to cease to carry on business; or

(e) There is a change in control of the Purchaser which in the reasonable opinion of PT JPPL Indonesia adversely affects the position, rights or interests of the Purchaser (For the purpose of this sub-clause, “control” means the ability to direct the affairs of another whether by virtue of contract, ownership of shares, or otherwise howsoever); or

(f) In the absolute opinion of PT JPPL Indonesia, there occurs a material change in the financial position of the Purchaser which is likely to affect the Purchaser’s ability to perform its obligations under the Contract; or

(g) PT JPPL Indonesia reasonably apprehends that any of the events mentioned above is about to occur in relation to the Purchaser and notifies in writing the Purchaser accordingly.

Termination of the Contract by PT JPPL Indonesia shall not discharge the Purchaser from any existing obligation accrued due on or prior to the date of termination.

The rights and remedies granted to PT JPPL Indonesia pursuant to this Agreement are in addition to, and shall not limit or affect, any other rights or remedies available at law or in equity.

Liability

The information, Services included in or available through the PT JPPL Indonesia Site may include inaccuracies or typographical errors. Changes are periodically made to the PT JPPL Indonesia site and to the information therein. PT JPPL Indonesia and/or its authorized agents may make improvements and/or changes in the PT JPPL Indonesia Site at any time. PT JPPL Indonesia and its authorized agents make no representations about the suitability, reliability, availability, timeliness, lack of viruses or other harmful components and accuracy of the information, products, services and related graphics contained within the PT JPPL Indonesia site for any purpose. All such information, products, services and related graphics are provided “as is” without warranty of any kind. PT JPPL Indonesia and its authorized agents hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties and conditions of merchantability, fitness for a particular purpose, workmanlike effort, title and non-infringement. You specifically agree that PT JPPL Indonesia is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another’s rights, including intellectual property rights.

Damages: In no event shall PT JPPL Indonesia or its authorized agents be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the PT JPPL Indonesia Site/Service, with the delay or inability to use the PT JPPL Indonesia Site/Service or related services, the provision of or failure to provide services, or for any information, products, services and related graphics obtained through the PT JPPL Indonesia Site/Service, or otherwise arising out of the use of the PT JPPL Indonesia Site/Service, whether based on contract, tort, negligence, strict liability or otherwise, even if PT JPPL Indonesia or any of its authorized agents have been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the PT JPPL Indonesia Site, or with any of these terms of use, your sole and exclusive remedy is to discontinue using the PT JPPL Indonesia Site.

Miscellaneous

This agreement is governed by the Laws of Indonesia.
